The Lahore High Court has taken notice of a plea filed by Arshad Khan, popularly known as the viral chaiwala after his Computerised National Identity Card (CNIC) and passport were blocked by NADRA and the immigration authorities.
Arshad became an internet sensation back in 2016 after a candid photo of him pouring tea went viral.
His case is represented in court by Barrister Umer Ijaz Gilani. He argued that blocking his identity documents is unfair, unlawful and goes against the Constitution of Pakistan.
His lawyer said that this sudden suspension of identity documents not only affects Arshad’s career but also damages his reputation.
According to the petition, NADRA’s demand for proof of residency before 1978 is unnecessary and legally questionable.
The lawyer pointed out that this act violates several constitutional rights including the right to dignity, livelihood and lawful treatment.
Barrister Gilani also referenced similar past court decisions where CNICs and passports were blocked without proper legal procedure and those decisions were overturned by the courts.
On the other hand government representatives argued that Arshad failed to provide solid proof of his Pakistani nationality.
After hearing both sides, Justice Jawad Hassan issued notices to the federal government, NADRA and immigration officials to respond by April 17. He also ordered top officials to appear in court with all relevant documents to explain their actions.
